Terms and Conditions

1. Definitions

a. ‘Business Days’ means the days of the week when normal business operations are conducted (Monday-Friday), excluding weekends and public holidays in New South Wales, Australia.

b. ‘Calendar Days’ means all days in a calendar month, including weekends and public holidays.

c. ‘Drawer’ means Mike Da Silva & Associates (Australia) Pty Ltd, the organisation responsible for conducting the prize draw.

d. ‘Eligible Account’ means an ‘Individual’ Superhero account type.

e. ‘Eligible Entrant(s)’ means an Individual Customer of Superhero who has met the below criteria and is therefore eligible for the Promotion.

1. 1. Is a QFF member (see Section 4 below).
   2. Has signed-up to a verified Superhero trading account.
   3. Is 18 years of age or older.
   4. Has a valid QFF number in their own name and is eligible to have Qantas Points credited to their nominated QFF account.
   5. Has provided Superhero with their QFF membership number and linked it to their Superhero account using the ‘Profile’ tab on the Superhero platform BEFORE trading on the Superhero platform (note: Qantas Points will NOT be earned on Eligible Trades that occur BEFORE a QFF number has been linked to a Superhero account).
   6. Has only linked their QFF membership number to one Superhero account in their name (note: Complimentary QFF membership offer can only be redeemed once by each Individual Customer on the Superhero platform and Individual Customers may not link QFF numbers to multiple Superhero accounts in their name).
   7. Has opted in to participate in the Promotion by clicking on the activation link provided via email. 
   8. Has completed an Eligible Trade on their Superhero trading account during the Offer Period.

f.  ‘Eligible Trade(s)’ means AU or US buy trades, executed where full brokerage is charged ($2 brokerage for all trades up to $20,000 or 0.01% brokerage for trades above $20,000, in respective currencies). $0 brokerage trades are excluded.

g. ‘Excluded Account(s)’ means SMSF, Company, Minor and Trust Superhero accounts which are not eligible for this Promotion.

h. ‘Excluded Entrants’ means individuals who are not eligible to participate in this Promotion, including:

1. 1. Directors, management, agents, and employees (and their Immediate Family members) of the Promoter, Sponsor, and any third party involved in the drawing process. and each of their related bodies corporate; 
   2. members whose QFF membership is suspended, cancelled or otherwise terminated at any time during the Offer Period or at the time of the prize draw or any redraw (as applicable).

i. ‘Immediate Family’ means a spouse, or former spouse, de facto partner or former de facto partner, child, parent, grandparent, step relationships as well as adoptive relationships.   

j. ‘Individual Customer(s)’ means an individual Superhero customer whose name and date of birth and/or address have been verified on the Superhero platform.

k. ‘MajorPrize’ means 500,000 Qantas Points with a maximum notional value of AU$29,451.07.

l. ‘Secondary Prize(s)’ means 100,000 Qantas Points with a maximum notional value of AU$5,890.21.

m. ‘Offer Period’ means from 9:00am AEDT on 3 February 2025 to 11:59pm AEDT on 8 March 2025 at 7:30 AM AEDT.

n. ‘Promotion’ means the ‘Win a share of 5 million Qantas points’ game of chance competition conducted during the Offer Period.

o. ‘Promoter’ means Superhero Markets Pty Ltd (ABN 36 633 524 261) of 4/6 Bligh St, Sydney New South Wales 2000 (telephone number 1300 675 148).

p. ‘QFF’ means Qantas Frequent Flyer.

q. ‘SMSF’ means Self Managed Super Fund.

r. ‘Sponsor’ means Qantas Airways Limited (ABN 16 009 661 901) of 10 Bourke Road, Mascot, New South Wales 2020. 

s. ‘Trading Week’ means the period of time during the week when trading is open on exchanges in Australia (ie. the Australian Securities Exchange (ASX) or in the United States (ie. the New York Stock Exchange (NYSE)).

t. ‘Winner(s)’ refers to an Eligible Entrant selected to receive either a Major or Secondary Prize through random selection.

2.General terms

a. Eligible Entrants will earn Qantas Points subject to these Terms and Conditions, the Superhero Terms and Conditions, the QFF Program Terms and Conditions and entry into the Promotion is deemed acceptance of all relevant Terms and Conditions which may be subject to variation from time to time.

b. This Promotion is open to Australian residents only.

c. Headings used in these terms and conditions are included for ease of reference and do not affect interpretation in any way.

d. The Promotion will be marketed by both the Promoter and the Sponsor.

e. All references to time in this document are a reference to the local time in Sydney, New South Wales, Australia on the date stated.

f. The Promoter will not be liable for any act, omission, event or circumstance which is beyond the reasonable control of the Promoter and prevents the Promoter from complying with any applicable terms and conditions for this Promotion.

g. By participating in this Promotion, Eligible Entrants agree to release and hold harmless the Promoter and its affiliates from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with the Promotion or the receipt, use, or misuse of any prizes associated with the Promotion.

h. The Promoter reserves the right to investigate all activities by Eligible Entrants and to disqualify any Eligible Entrants at its sole discretion as deemed fair and appropriate.

i. The Promoter accepts no responsibility for any tax implications that may arise for a Winner when accepting a prize and Winners should seek independent financial advice.

j. The Promoter reserves the right to modify, suspend or terminate all or part of this Promotion and these Terms and Conditions at any time at its sole discretion for administrative purposes or to ensure the efficient operation of the Promotion, subject to relevant regulatory approval. 

k. Any modifications to these Terms and Conditions will be effective from the date of posting on Superhero’s website at www.superhero.com.au.

l. These terms and conditions will be governed by the laws of New South Wales, and will be subject to the jurisdiction of the New South Wales Courts.

3. Privacy

a. The personal information provided by Eligible Entrants will be used solely by the Promoter and Sponsor for the purposes of conducting the Promotion and in accordance with the Privacy Policy of the Sponsor as well as the Privacy Policy of the Promoter.

b. By entering this Promotion, Eligible Entrants consent to the Promoter and the Sponsor disclosing their personal information to third parties involved in assisting with the administration of the Promotion as required.

c. By entering this Promotion, Eligible Entrants provide their consent for their first initial, surname and Australian state of origin (eg. NSW) to be utilised on the Promoter and Sponsor’s websites and social media platforms in the event they become Promotion Winners.

4. QFF membership

a. If you have an existing QFF account, you can provide your QFF membership number to Superhero using the Superhero trading platform.

b. If you are not an existing QFF member, Superhero and Qantas are pleased to offer complimentary QFF membership to Superhero customers with an Australian residential address (valued at AU$99.50 incl. GST). If you are not a QFF member, join for free here. 

c. Superhero is unable to refund a QFF membership fee if you sign up to the QFF program via another medium, method or channel.

5. Promotion details and terms

a. To enter the Promotion, you must:

1. 1. Ensure you meet the criteria of an Eligible Entrant and are within the Offer Period; and
   2. Place one or more Eligible Trades during the Offer Period (entries are capped at fifteen (15) per Individual Customer per Trading Week).

b. Any trades made within Superhero Super or on Excluded Account types are not eligible for this Promotion.

c. Pending and cancelled trades are excluded from this Promotion.

d. Six (6) Eligible Entrants will be selected at random at the end of each Trading Week during the Offer Period to win a share of one (1) million Qantas Points per week for a total of 30 customers and five (5) million points over a period of five (5) weeks. 

e. Eligibility to win Qantas Points resets at the beginning of every Trading Week.

f. Eligible Entrants are only able to be drawn as a Winner once for the duration of the Promotion.

g. Promotion Winners will be notified by email and announced via a Superhero Instagram story and on Superhero’s website at www.superhero.com.au at the end of each Trading Week.

h. If you are a Promotion winner, Qantas Points will be credited to your QFF account within 30 days of the end of the Offer Period. You can view the Qantas Points credited to your QFF account by logging into www.qantas.com/frequentflyer.

6. Prize details

a. There will be one (1) Major Prize and five (5) Secondary Prizes awarded in a draw at the end of each Trading Week that have a total notional weekly value of AU$58,902.15.

b. The maximum notional value of the total prize pool for the entire five (5) week duration of the Promotion is AU$294,510.74, based on a sample of the QFF Rewards that could be obtained by transferring the points to a QFF account and redeeming through the QFF program (as fully defined in the terms and conditions of the QFF program available at qantas.com/terms). For example 41,900 Qantas Points could be redeemed for a Flex one way Economy Classic Flight Reward from Sydney to Los Angeles plus AU$234.00 including applicable taxes, fees and carrier charges as at 12 November 2024. The dollar fare for an equivalent commercial flight totals AU$2,702.00 including taxes, fees and carrier charges.

c. The estimate of the maximum notional value of each prize is provided for information purposes only. The maximum notional value of each prize will vary depending on whether and how it is redeemed by a winner through the QFF program. The Promoter and Sponsor of this Promotion accept no responsibility for any variation in the maximum notional value of each prize.

d. The redemption of each Prize is subject to the availability of rewards that may be obtained through the QFF program.

e. Each prize must be taken as stated and no compensation will be payable if a Winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize cannot be transferred to any other person, unless agreed to by the Promoter. It is a condition of accepting a prize that the Winner accepts the conditions of use of that prize.

f. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal notional value and/or specification, subject to any written directions from a regulatory authority.

7. Prize draws 

a. Prize draws will be conducted at 10am (AEDT) on the Monday after each Trading Week.

b. Prize draws will be conducted by Drawer at the following address:

1. Level 16, 1 Denison Street, North Sydney NSW 2060.

c. The result of each prize draw is final and no correspondence will be entered into.

d. The Promoter reserves the right to redraw in the event of an Eligible Entrant being unable to satisfy these terms and conditions, forfeiting or not claiming a prize. For any prize that remains unclaimed at 5:00pm (AEST) on 10 April 2025, a second draw will be conducted by the Drawer on 24 April 2025 at the same time and place as the original draw, subject to any written direction given under applicable law. Any Winner determined in accordance with this clause will be notified in writing within one (1) business day of the redraw. Their first initial & surname will be published on www.superhero.com for 28 Calendar Days from 28 April 2025, and on Superhero’s Instagram for 24 hours from 28 April 2025. The postcode of any Winner who is a South Australian resident will also be published, unless that Winner requests otherwise.

e. Where required, any prize redraws will be conducted at the same time and location as the original prize draw one (1) Business Day after the originally scheduled prize draw date, subject to any written direction given under applicable law.

8. Winner notification details

a. Within one (1) Business Day of each prize draw, the Promoter will notify prize Winners via the email provided to the Promoter by the Eligible Entrant.

b. Prize Winners first initial, surname, and state of origin (e.g. NSW) will be listed on Superhero’s website at www.superhero.com for 28 Calendar Days and on Superhero’s Instagram for 24 hours from the date of each prize draw. The postcode of any Winner who is a South Australian resident will also be published online unless that Winner requests otherwise.

c. Where a Winner is found to not be an Eligible Entrant they will be disqualified from the Promotion and will forfeit receipt of any prize. A redraw will be conducted in accordance with Section 7 of these Terms and Conditions. 

9. Permit details

a. This Promotion is authorised under NSW NTP/12120, ACT TP25/00024 & SA Licence No. T25/14.
